1. Introduction

Welcome to NestAlert. These Terms of Service ("Terms") govern your use of our WhatsApp-based property alert service. By using NestAlert, you agree to be bound by these Terms.

Please read these Terms carefully before using our service. If you do not agree with any part of these Terms, you may not use our service.

2. Service Description

NestAlert is a property alert service that monitors rental listings on Rightmove, Zoopla, OpenRent, and SpareRoom. We send you WhatsApp notifications when new properties matching your specified criteria become available.

Our service is designed to help you discover rental properties quickly, but we do not guarantee the availability, accuracy, or suitability of any property listings.

3. Free Trial

We offer a 3-day free trial to new users. During the trial period:

  • You will have full access to our property alert service
  • No payment information is required to start the trial
  • The trial will automatically end after 3 days unless you subscribe

4. Subscription and Pricing

After your free trial ends, continued use of NestAlert requires a paid subscription:

  • Price: £15.99 per month
  • Billing: Subscriptions are billed monthly in advance
  • Currency: All prices are in British Pounds Sterling (GBP)

We reserve the right to change our pricing with reasonable notice. Any price changes will be communicated to you before they take effect.

5. Cancellation Policy

You may cancel your subscription at any time:

  • To cancel, simply message us on WhatsApp or email us at hello@nestalert.co.uk
  • Your subscription will remain active until the end of your current billing period
  • You will continue to receive alerts until your subscription period ends

6. Refund Policy

Due to the nature of our digital service:

  • We do not offer refunds for partial months of service
  • If you cancel mid-month, you will retain access until the end of your billing period
  • In exceptional circumstances, refunds may be considered at our discretion

7. Service Availability

We strive to provide a reliable service, however:

  • We do not guarantee 100% uptime or uninterrupted service
  • The service may be temporarily unavailable due to maintenance or technical issues
  • We are not responsible for delays caused by WhatsApp or third-party property websites
  • Property listings are sourced from external websites and may be removed or changed at any time

8. User Responsibilities

By using our service, you agree to:

  • Provide accurate information about your property preferences
  • Use the service for personal, non-commercial purposes only
  • Not attempt to reverse-engineer, copy, or redistribute our service
  • Not use the service for any illegal or unauthorised purpose
  • Keep your WhatsApp number up to date to receive alerts

9. Limitation of Liability

To the fullest extent permitted by law:

  • NestAlert is provided "as is" without warranties of any kind, express or implied
  • We are not responsible for any decisions you make based on property alerts
  • We are not liable for any indirect, incidental, or consequential damages
  • We are not responsible for the accuracy of property listings from third-party websites
  • Our total liability shall not exceed the amount you paid for the service in the preceding 12 months

10. Intellectual Property

All content, trademarks, and intellectual property related to NestAlert are owned by us. You may not use, copy, or distribute our branding or content without written permission.

11. Termination

We reserve the right to suspend or terminate your access to NestAlert at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes via WhatsApp or email. Your continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
